Dutyholder Support

Independent Dutyholder Support Helping Organisations Meet Their Asbestos Management Responsibilities

Managing asbestos is an ongoing legal responsibility that extends far beyond commissioning an asbestos survey. Dutyholders must ensure that asbestos-containing materials are identified, managed appropriately and monitored throughout the life of a building.

At Asbestos Compliance, we provide independent Dutyholder Support services, helping organisations understand their legal obligations, develop practical asbestos management systems and maintain ongoing compliance with the Control of Asbestos Regulations 2012.

Whether you manage a single commercial property or an extensive property portfolio, our consultants provide clear, practical advice tailored to your organisation and operational requirements.

Independent asbestos consultant providing dutyholder support to help organisations manage asbestos and maintain legal compliance.

What Is the Duty to Manage Asbestos?

The Duty to Manage asbestos is set out under Regulation 4 of the Control of Asbestos Regulations 2012.

The legislation requires those responsible for the maintenance or repair of non-domestic premises to identify asbestos-containing materials, assess the associated risks and implement arrangements to prevent accidental disturbance.

The objective is not necessarily to remove all asbestos, but to ensure that asbestos-containing materials remain in a safe condition and that anyone liable to disturb them is provided with appropriate information before work begins.

Effective asbestos management is therefore an ongoing process involving surveys, asbestos registers, management plans, regular reviews and clear communication with contractors and maintenance personnel.

Who Is the Dutyholder?

The dutyholder is generally the person or organisation responsible for repairing or maintaining non-domestic premises.

This may include:

  • Commercial landlords

  • Building owners

  • Facilities managers

  • Managing agents

  • Employers responsible for their own premises

  • Housing associations

  • Local authorities

  • NHS Trusts

  • Schools and academies

  • Colleges and universities

  • Industrial operators

  • Retail organisations

In some buildings there may be more than one dutyholder, depending upon contractual responsibilities.

Understanding these responsibilities is essential to maintaining legal compliance.

What Are the Dutyholder's Responsibilities?

Dutyholders are expected to implement appropriate arrangements for managing asbestos within their premises.

These responsibilities typically include:

  • Identifying asbestos-containing materials.

  • Maintaining an up-to-date asbestos register.

  • Preparing and implementing an asbestos management plan.

  • Monitoring the condition of asbestos-containing materials.

  • Arranging periodic asbestos re-inspections.

  • Providing asbestos information to contractors before work begins.

  • Reviewing management arrangements regularly.

  • Maintaining accurate records.

  • Responding appropriately to damaged asbestos.

  • Ensuring appropriate staff training where required.

These duties continue throughout the occupation and management of the building.

Why Is Ongoing Compliance Important?

Managing asbestos is not a one-off exercise.

Buildings change over time through refurbishment, maintenance, occupancy changes and natural deterioration of asbestos-containing materials.

Without regular review, asbestos information can quickly become outdated, increasing the likelihood of accidental disturbance.

Effective dutyholder support helps organisations:

  • Reduce asbestos-related risks.

  • Maintain accurate records.

  • Improve contractor management.

  • Demonstrate compliance during inspections or audits.

  • Protect employees, contractors and occupants.

  • Plan future maintenance safely.

  • Reduce operational disruption.
